Experience

Hugo Oppelaar is one of the founding partners of FMLA Financial Markets Lawyers. He represents Dutch and non-Dutch financial services firms, issuers of publicly traded securities, a large number of pension funds and various types of asset managers, including discretionary and fiduciary asset managers, hedge funds, real estate funds, UCITS and other investment funds and managers thereof. Hugo advises on a broad range of financial regulation and investment management matters (e.g. the Act on Financial Supervision, the Pension Act, investment management agreements, custody, governance, compliance, product (fund) structuring, legal documentation and other investment funds related work). He advises on any issues with respect to supervision by the Authority for the Financial Markets and the Dutch Central Bank (de Nederlandsche Bank)  He further assists with capital markets transactions and public takeover bids. Before he joined FMLA, Hugo Oppelaar led Houthoff Buruma's Financial Regulatory Practice Group and (jointly with Louis Kuypers, Houthoff's former pension law partner) headed Houthoff's leading Pension Sector Group. He was one of the two partners within the firm specializing in investment management and advised on many capital markets transactions as well as public takeover bids. Hugo started his career as adviser to the Dutch Minister of Finance on financial laws and regulations. He was closely involved in the reorganization of the Dutch regulatory framework leading to the introduction of the Twin Peaks supervisory model with one cross-sector conduct of business regulator, the Authority for the Financial Markets (AFM), and one cross-sector prudential regulator, the Nederlandsche Bank (DNB).

Publications and other professional activities

Hugo Oppelaar regularly publishes in various books, leading law journals and newspapers and is co-author of a commentary on the Dutch Act on Financial Supervision. In 2004 he wrote a preliminary advice (preadvies) on the introduction of the same act for the Dutch Securities Law Association (Nederlandse Vereniging voor Effectenrecht).
Hugo is a member of the board and general secretary to the Dutch Securities Law Association and a member of the editorial staff of the Dutch Compliance Journal (Tijdschrift voor Compliance). He is a popular speaker and lecturer.
